Why in News?

On 5 September 2026, the National Biodiversity Authority (NBA) crossed a cumulative milestone of ₹200 crore in Access and Benefit-Sharing (ABS) disbursements. In the latest tranche, the Authority sanctioned ₹8.23 crore to 27 State Biodiversity Boards and 5 Union Territory Biodiversity Councils. The proceeds arose from the research and commercial utilisation of biological resources associated with bitter gourd, okra, chilli and onion.

The money had been realised from seed companies that accessed these biological resources. A particularly important feature of the case is that the original resource providers could not be individually traced because the material had been obtained through open markets or traders. The benefit share was therefore distributed among States and Union Territories where the crops are cultivated, using area-under-cultivation data published by the Ministry of Agriculture and Farmers Welfare.

This transforms a seemingly narrow environment news item into a much larger UPSC issue involving biodiversity governance, ecological justice, community rights, conservation finance, traditional knowledge, genetic resources, federal institutions and international environmental commitments.

What is Access and Benefit-Sharing?

Access and Benefit-Sharing is based on a simple but powerful principle: if biological or genetic resources, or knowledge associated with them, are used for research, product development or commercial gain, the benefits arising from such use should not accrue only to the user. A fair share should flow back to the providers, custodians, communities and conservation system connected with those resources.

The logic can be represented as:

Biological resource / associated knowledge → regulated access → research or commercial utilisation → monetary and/or non-monetary benefits → sharing with legitimate beneficiaries → conservation and sustainable use.

Benefits need not always be cash payments. They may include technology transfer, collaborative research, training, local infrastructure, joint intellectual-property arrangements, capacity building or other mutually agreed forms of benefit.

Why does ABS matter?

1. It converts biodiversity from an unpriced input into a governed resource

Modern agriculture, pharmaceuticals, biotechnology, cosmetics, seed development and other sectors frequently depend on biological resources and genetic traits. Without an ABS system, value can be extracted from biodiversity while the ecological and social costs remain with local communities and the public.

2. It creates an equity link between users and custodians

Communities may conserve crop varieties, medicinal plants, microbial resources or associated traditional knowledge for generations. ABS recognises that commercial value often rests on an ecological and knowledge base that predates the final product.

3. It can generate conservation finance

When benefits are channelled into biodiversity institutions, local registers, ecosystem restoration, heritage sites and community livelihoods, utilisation itself can help finance conservation.

4. It acts as a safeguard against biopiracy

A transparent access-and-benefit framework reduces the possibility that biological resources or associated knowledge are commercially appropriated without consent, recognition or benefit sharing.

India’s Biodiversity Governance Architecture

India’s system is built around the Biological Diversity Act, 2002, which was substantially amended by the Biological Diversity (Amendment) Act, 2023. The amendment came into force on 1 April 2024. It is now complemented by the Biological Diversity Rules, 2024 and the Biological Diversity (Access to Biological Resources and Knowledge Associated thereto and Fair and Equitable Sharing of Benefits) Regulations, 2025, which superseded the 2014 ABS guidelines for future cases.

The institutional structure is multi-level:

  • National Biodiversity Authority (NBA): a statutory body under the Ministry of Environment, Forest and Climate Change, with national-level functions relating to regulated access, approvals, benefit sharing and biodiversity governance.
  • State Biodiversity Boards (SBBs): constituted under Section 22 of the Act at the State level.
  • Union Territory Biodiversity Councils (UTBCs): perform corresponding functions in Union Territories.
  • Biodiversity Management Committees (BMCs): constituted at the local level under Section 41 and central to documentation, local biodiversity governance and ABS-linked community participation.

For UPSC, the key lesson is that biodiversity governance is not a single-agency model. It combines central regulation, State-level institutions and local-level participation.

What changed after the 2023 Amendment?

The amendment sought to make the framework more workable while retaining the conservation and benefit-sharing objectives of the Convention on Biological Diversity and the Nagoya Protocol. Official government material identifies objectives such as encouraging cultivation of medicinal plants, supporting Indian systems of medicine, facilitating research and patent processes, decriminalising certain contraventions and improving the investment environment in biological-resource value chains.

This creates an important policy tension for Mains answers:

Too much regulatory friction can discourage research and innovation; too little regulation can weaken community rights, traceability and fair benefit sharing.

The appropriate policy goal is therefore not maximum regulation or minimum regulation, but credible, predictable and proportionate regulation.

The 2025 ABS Regulations: Why they are important

The 2025 regulations modernise the operational framework for benefit sharing. Significantly, they expressly deal with biological resources including digital sequence information (DSI) in specified access contexts. This is important because value derived from biodiversity is increasingly detached from the physical movement of a seed, plant or microbe. Genetic information can be digitised, analysed and used in research or innovation across borders.

This is one of the emerging challenges of global biodiversity law: how should benefits be shared when economic value comes from digital genetic information rather than a physical sample?

What exactly happened in the latest ₹8.23 crore disbursement?

The latest proceeds relate to four crops: bitter gourd, okra, chilli and onion. They were realised from seed companies in connection with access to these biological resources for research and commercial utilisation.

Because the resources had been accessed through open markets or traders, the NBA could not reliably identify a single farmer, community or geographic source as the original provider. The Authority therefore adopted an area-based distribution approach among the States and Union Territories where the crops are cultivated.

Madhya Pradesh and Maharashtra emerged as the largest cumulative recipients across the four crops. Maharashtra’s position was strongly influenced by its large share in national onion cultivation.

Why the area-under-cultivation formula is an important case study

The formula is administratively practical, but analytically it raises a deeper question: Does geographic cultivation area perfectly represent contribution to a genetic resource?

Its strengths are clear. It allows benefits to be distributed even when direct traceability is impossible, avoids indefinite retention of funds, and sends resources towards biodiversity institutions in the crop-growing regions. Yet it also has limitations. The present cultivation area may not identify the historical origin of a variety, the community that conserved a trait, the farmer network that maintained genetic diversity or the location from which the commercial material was ultimately derived.

Therefore, the current case should be viewed as a pragmatic solution to a traceability problem, not necessarily as a universal model for every ABS situation.

How can the funds be used?

The government release states that State Biodiversity Boards and Union Territory Biodiversity Councils are to use such funds for activities under Section 32(2) of the Act. These include:

  • documentation and updating of People’s Biodiversity Registers;
  • in-situ and ex-situ conservation of biological resources;
  • restoration of degraded ecosystems;
  • strengthening Biodiversity Heritage Sites;
  • capacity building of Biodiversity Management Committees; and
  • enhancement of community livelihoods.

This is why ABS should be understood as more than compensation. Properly designed, it is also a form of biodiversity finance.

People’s Biodiversity Registers: The local knowledge layer

People’s Biodiversity Registers document locally available biological resources and associated knowledge. Their importance is not merely clerical. A credible register can strengthen local knowledge systems, improve documentation, support conservation planning and help establish a clearer link between resources and communities.

However, a weakly prepared register can become a box-ticking exercise. UPSC answers should therefore distinguish between register creation and register quality, updating, community ownership and actual policy use.

International Linkage: CBD and the Nagoya Protocol

Fair and equitable sharing of benefits arising from the utilisation of genetic resources is one of the central objectives of the Convention on Biological Diversity (CBD). The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization provides a more specific international framework for ABS. It entered into force on 12 October 2014.

Its objective is not benefit sharing in isolation. Fair benefit sharing is intended to contribute to biodiversity conservation and sustainable use. The Protocol also emphasises legal certainty, access procedures, mutually agreed terms, prior informed consent where applicable, traditional knowledge and information sharing through the ABS Clearing-House.

Kunming-Montreal Global Biodiversity Framework: Target 13

Target 13 of the Kunming-Montreal Global Biodiversity Framework calls for effective legal, policy, administrative and capacity-building measures to ensure fair and equitable sharing of benefits arising from the utilisation of genetic resources, digital sequence information and associated traditional knowledge, and seeks a significant increase in benefits shared by 2030.

The ₹200 crore milestone therefore has an international dimension: it is evidence of India operationalising an institutional benefit-sharing system rather than treating ABS as a purely treaty-level promise.

Why this issue is really about ecological justice

Markets frequently reward the final stages of innovation more visibly than the ecological and cultural systems from which biological value originates. ABS attempts to correct this imbalance. It asks a normative question: Who should benefit when nature, genetic diversity or community-held knowledge becomes economically valuable?

In that sense, ABS connects environment policy with distributive justice. It recognises that conservation costs and knowledge contributions are often local, whereas commercial gains may be national or global.

संशोधन का उद्देश्य संरक्षण और लाभ-साझाकरण के मूल लक्ष्यों को बनाए रखते हुए व्यवस्था को अधिक व्यावहारिक बनाना था। आधिकारिक सरकारी सामग्री के अनुसार इसके प्रमुख उद्देश्यों में औषधीय पौधों की खेती को प्रोत्साहन, भारतीय चिकित्सा पद्धतियों को सुविधा, अनुसंधान और पेटेंट प्रक्रियाओं को सरल बनाना, कुछ उल्लंघनों को अपराध की श्रेणी से हटाना तथा जैविक संसाधनों की मूल्य-श्रृंखला में निवेश को सुगम बनाना शामिल है।

राशि का उपयोग कहाँ किया जा सकता है?

जन जैव विविधता पंजिका: स्थानीय ज्ञान की आधारशिला

जन जैव विविधता पंजिकाएँ स्थानीय जैविक संसाधनों और उनसे जुड़े ज्ञान का प्रलेखन करती हैं। उनका महत्त्व केवल सूची बनाने तक सीमित नहीं है। अच्छी गुणवत्ता वाली पंजिका स्थानीय ज्ञान-व्यवस्था को सुदृढ़ कर सकती है, संरक्षण-योजना में सहायता दे सकती है और संसाधन तथा समुदाय के बीच संबंध को अधिक स्पष्ट बना सकती है।
